First-party Content
All websites owned and operated by Heavy Element (herein Company, Us, Our, We) including, but not limited to, heavyelement.com, shop.heavyelement.com, subscribeto.me, podcast.subscribeto.me, forum.heavyelement.io (collectively "Sites") are protected under this notice.
Unless where otherwise noted, Heavy Element reserves all moral and civil copyrights to our work (herein "Content") including all text, images, photographs, video, audio, code, binary, and other media.
Third-party Content
From time to time, we may include logos, images, and other media from our Clients (herein "Third-party Content"). This may or may not include Content we've created for a client or other material which we may have a license to distribute. We make no claim of copyright or ownership over such Third-party Content.
First-party Content and Third-party Content are collectively referred to as "Protected Work."
Prohibition of AI Training
UNDER NO CIRCUMSTANCES shall Protected Work be used in the training of, prompting of, or otherwise consumed by (collectively "Consumed") so-called Generative AI.
UNDER NO CIRCUMSTANCES shall Protected Work be scraped, crawled, collected, stored, cached, indexed, or otherwise duplicated (herein "Scraping") for such purposes.
We consider all unauthorized use of Protected Work for the training, prompting, consideration, or generative output of AI (herein "Slop") to be Copyright Infringement under Title 17 of the United States Copyright Law.
We consider the act of Scraping Protected Work hosted on Our Sites to be theft of our limited server bandwidth.
We have a good-faith belief that any Slop generated using Protected Work as training data or as a prompt is an Unauthorized Derivative Work and therefore Criminal Copyright Infringement (17 USC § 506(a)).
We reserve the right to the fullest extent of legal action should anyone cause Protected Content hosted on Our Sites to be Consumed by so-called Generative AI or Scraped for such purposes.
